Privacy Policy

Flamingo PLM shall take appropriate technical and organisational measures concerning the processing operations of personal data to be carried out, against loss or any form of unlawful processing (such as unauthorised access, corruption, alteration or provision of the personal data). We perform regular backups of the website and its content and we ensure the completeness and accuracy of these backups. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice. Your coaching session bookings are only accessible by Flamingo PLM and are not passed on to any third party. 

If Flamingo PLM becomes aware of any unauthorised or unlawful access to, or acquisition, alteration, use, disclosure, or destruction of, personal data related to you (“Security Incident”), we will take reasonable steps to notify you without undue delay, but in any event within 72 hours of becoming aware of the Security Incident. We will also reasonably cooperate with you with respect to any investigations relating to a Security Incident with preparing any required notices, and provide any other information reasonably requested by you in relation to any Security Incident, where such information is not already available to you or online through updates provided by us. 

Release of Information 

The Coach engages in training and continuing education pursuing and/or maintaining further ICF credentials. That process requires the names and contact information of all clients for possible verification by ICF. By signing this agreement, you agree to have only your name, contact information and start and end dates of coaching shared with ICF staff members and/or other parties involved in this process for the sole and necessary purpose of verifying the coaching relationship, no personal notes will be shared. 

Record Retention Policy

The Client acknowledges that the Coach has disclosed his/her record retention policy with respect to documents, information and data acquired or shared during the term of the Coach-Client relationship. Such records will be maintained by the Coach in a format of the Coach’s choice (print or digital/electronic) for a period of not less than 1 year after the termination of the coaching agreement.

Intellectual property rights and copyright 

The content of the website services are provided on the site “AS IS” for your information and personal use only. No part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission. 

Your use of the website and service bookings do not give you the right or license to reproduce or use any of our content, title to patents, inventions, copyrights, trademarks, domains name or any other intellectual property owned by us. 

Termination

Either the client or the coach may terminate this Agreement at any time with one weeks written notice. The client agrees to compensate the Coach for all coaching services rendered through and including the effective date of termination of the coaching relationship.

Limited Liability

The client understands, agrees and acknowledges that in no event will Flamingo PLM, or such Party’s affiliates or their respective officers, directors, employees, agents, suppliers or licensors be liable to the other Party or any third party for any indirect, incidental, exemplary, consequential, punitive or other similar damages, including lost profits, lost sales or business, business interruption or any other loss incurred by such Party in connection with these terms or the Service. 

Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach under this Agreement for all coaching services rendered through and including the termination date. 

Dispute Resolution 

If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Client and Coach agree to attempt to mediate in good faith for up to 30 days after notice given. If the dispute is not so resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party. 

Binding Effect 

This Agreement shall be binding upon the parties hereto and their respective successors and permissible assigns. Please sign both copies and return one copy of this Client Agreement prior to the first scheduled coaching meeting. 

Waiver

The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement. 

Changes in assignment

We may change these Terms at any time for a variety of reasons, such as to reflect changes in applicable law or updates to Services, and to account for new Services or functionality. The most current version will always be posted on www.peoplelikeme.je

Changes will be effective no sooner than the day they are publicly posted. If you do not agree to the changes made to the terms for a Service, you should stop using our website and services, because by continuing to use our website and services you indicate your agreement to be bound by the updated terms. 

Governing Law and Jurisdiction 

The Contract shall be governed by and construed in accordance with Jersey law. By using the services provided by Flamingo PLM you agree that the courts of Jersey shall have nonexclusive jurisdiction to deal with any claim, difference or dispute which may arise in connection with the service.

  1. Training and Consultancy

Booking

A booking for training or contract work and consultancy can be negotiated verbally but will only be accepted and confirmed via email. Within 24 hours of a course booking or consultancy services agreed an invoice will be sent to the client and will be due for payment within 14 days.

Cancellation Policy

Please note that once you have booked a training session with FlamingoPLM it means a time in the schedule has been reserved exclusively for you. If you cancel the booking for a training course within 28 days of the course start date you will still be charged even if payment has not yet been received at that point. Replacement delegates are accepted right up until the last minute.

 All training events are planned to take place in person. However, in the event of unforeseen circumstances (e.g pandemic) we may have to alter the venue, date or transfer to virtual delivery but without compromising quality.

In the event of a course having to be cancelled last minute due to trainer sickness we will get in touch to offer an alternative future course date or offer a refund - whichever is the preferred route.

Please note Flamingo PLM is not responsible for consequential costs or any travel related expenditure resulting from a cancelled course.

Security

Personal possessions are the sole responsibility of the customer and Flamingo PLM accepts no responsibility for anything that is lost or stolen from the course venue. Customers are advised to keep valuables with them at all times.

Intellectual Property

The customer warrants that they shall only use FLAMINGO PLM materials for their own educational purposes and shall not, without prior written consent, copy, make available, reproduce, sell, disseminate, licence, distribute, publish or otherwise circulate these materials for any other purpose.

Formal Data Protection Policy

Customers agree that, in relation to email addresses and names held, from time to time Flamingo PLM may:

  • Use the information to inform customers about courses which may be of interest

  • Use the information to send joining instructions and inform customers of feedback

  • In the event that customers do not wish to receive correspondence from a written request should be sent to flamingoplm2022@gmail.com

All information is kept securely and has anti-virus protection.

We may ask to use feedback comments from you for marketing purposes. We will only do this with your written permission. 

We will not share your data with any other organisation, apart from if required to do so by law. We may keep personal data only for as long as necessary to fulfil the purposes for which we are processing your personal information unless the law permits or requires longer. If you think we have used your personal data unfairly then you have the right to complain to us and to the authority responsible.
